ORDER POLICY
We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.
The technical steps required to create the contract between you and us are as follows:
You place the order for your products on the Website by pressing the confirm order button at the end of the checkout process. You will be guided through the process of placing an order by a series of simple instructions on the Website
We may send you an order acknowledgement email as soon as you place your order, detailing the Products you have ordered. These emails do not constitute acceptance of your order
For items being delivered to you (as opposed to Click & collect), when your product is shipped from our warehouse we will send you a despatch confirmation email
Order acceptance and the completion of the contract between you and us will take place on the despatch to you of the Products ordered unless we have notified you that we do not accept your order, or you have cancelled it in accordance with the instructions in our cancellation policy
For products sent or collected directly from our warehouse your credit card will be charged when your order is placed.
DELIVERY
Subject to the specific terms of any special delivery service, delivery can take place at any time of the day and must be accepted at any time between 8 am to 8 pm
If you do not take delivery of the product we may, at our discretion and without prejudice to any other rights:
a. store or arrange for the storage of the product and will charge you for all associated costs and expenses including, but not limited to, transportation, storage and insurance; and/or
b. make arrangements for the redelivery of the product and will charge you for the costs of such redelivery; and/or
c. after 10 business days, resell or otherwise dispose of part or all of the product and charge you for any shortfall below the price of the product.
Any date or time quoted for delivery will be approximate. We will not be liable for any delay in delivery that is caused by a circumstance beyond our control or your failure to provide us with adequate delivery instructions or any other instructions that are relevant to the supply of the Product.
You must inspect the Products on delivery or collection. If you identify any damages or shortages, you must inform us in writing within 1 day of delivery, providing details.
CLICK AND COLLECT
You must collect the products from Unit 5 Guinness Park Farm Leigh Sinton Worcestershire WR13 5EQ within 30 days of placing your order. Thereafter the products will be returned to our stock and we cannot guarantee the product will be available for you.
RETURNS POLICY
If you change your mind about keeping your purchase, please advise us within 14 days of receiving your goods and return within the next 14 days in its original condition with proof of purchase. We will exchange or refund it as long as it meets our terms and conditions explained below.
By original condition we mean
· The product is in in good condition and the product can be resold at full price
· You have not used the product.
· The product has not been resold or irreversibly incorporated into another product
If you return products which are within our returns policy you’ll receive a refund within 10 days of returning the item to the same payment method you used
If you return products which are outside our returns policy or if you don’t have proof of purchase, we’re unable to process a refund or exchange, so please keep your order confirmation.
LIMITATION OF LIABILITY
Our liability under these terms and conditions, and in breach of statutory duty, and in tort, misrepresentation or otherwise will be limited to this clause
Subject to the clauses above on Delivery, all warranties, conditions or other terms implied by statute or common law (save for those implied by Section 12 of the Sale of Goods Act 1979) are excluded to the fullest extent permitted by law
Our total liability will not, in any circumstances, exceed the total amount of the Price payable by you
We will not be liable (whether caused by our employees, agents or otherwise) in connection with the Goods, for:
a. any indirect, special or consequential loss, damage, costs, or expenses; and/or
b. any loss of profits; loss of anticipated profits; loss of business; loss of data; loss of reputation or goodwill; business interruption; or, other third party claims; and/or
c. any failure to perform any of our obligations if such delay or failure is due to any cause beyond our reasonable control; and/or
d. any losses caused directly or indirectly by any failure or breach by you in relation to your obligations; and/or
e. any loss relating to the choice of the Goods and how they will meet your purpose or the use by you of the Goods supplied
CIRCUMSTANCES BEYOND THE CONTROL OF EITHER PARTY
Neither party shall be liable for any failure or delay in performing their obligations where such failure or delay results from any cause that is beyond the reasonable control of that party. Such causes include, but are not limited to: power failure, internet service provider failure, industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism, acts of war, governmental action or any other event that is beyond the control of the party in question
